Welcome to Atoshia. These Terms of Service govern your use of
atoshia.com and any purchase you make from us. By using this site
or placing an order, you agree to these terms.

Atoshia is operated by ISDU LLC, a Wyoming limited liability
company ("we", "us", "our"). "You" means the person using the site
or placing an order.

1. WHO CAN BUY FROM US

You must be at least 18 years old to place an order.

We currently sell and ship only to addresses within the United
States. Orders with a shipping address outside the US will be
cancelled and refunded.

2. OUR PRODUCTS

We sell dietary supplements. Dietary supplements are not drugs.
They are not reviewed or approved by the U.S. Food and Drug
Administration before sale, and they are not intended to diagnose,
treat, cure or prevent any disease.

Nothing on this site is medical advice. We can tell you what is in
our products, how much of it, and how to take them. We cannot tell
you whether a supplement is appropriate for you.

Consult a qualified healthcare professional before taking any
supplement, particularly if you are pregnant or nursing, take
prescription medication, or have a diagnosed medical condition.
Do not use our products as a substitute for medical care.

You are responsible for reading the label and following the
suggested use.

3. PRODUCT INFORMATION AND ACCURACY

We try to describe our products accurately, including ingredients,
dosage, images and pricing. We do not warrant that every
description is error-free or complete.

Product images are representative. Labels, packaging and
formulations may change; the label on the product you receive is
authoritative.

We reserve the right to correct errors and to change prices,
descriptions and availability at any time without notice. If we
correct a pricing error after you order, we will contact you and
give you the choice of confirming at the corrected price or
cancelling for a full refund.

4. ORDERS AND ACCEPTANCE

Your order is an offer to buy. We accept it when we send you a
shipping confirmation, not when you place it or when payment is
authorised.

We may refuse or cancel any order, including after payment, if:

  - the product is unavailable
  - there was an error in pricing or description
  - we suspect fraud or unauthorised payment
  - the order appears to be for resale
  - the order breaches these terms

If we cancel an order you have paid for, we refund it in full.

Quantities may be limited per customer or per order.

5. PRICES AND PAYMENT

All prices are in US dollars and exclude any applicable sales tax,
which is calculated at checkout.

By providing payment details you confirm that you are authorised
to use that payment method and that the information is accurate.
Payments are processed by our payment providers; we do not store
your full card details.

6. SUBSCRIPTIONS

If you subscribe, you authorise us to charge your payment method
on a recurring basis until you cancel.

Full subscription terms — billing dates, pricing, notice of price
changes, how to skip, pause or cancel, and what happens if a
payment fails — are set out in our Subscription Policy, which
forms part of these terms.

You can cancel at any time from your account. There is no minimum
term and no cancellation fee.

7. SHIPPING

Shipping terms, processing times and delivery estimates are set
out in our Shipping Policy, which forms part of these terms.

Delivery estimates are estimates, not guarantees. Risk of loss
passes to you on delivery by the carrier.

8. RETURNS AND REFUNDS

Our Return and Refund Policy forms part of these terms and sets
out our 30-day money-back guarantee and its limits.

9. YOUR ACCOUNT

If you create an account, you are responsible for keeping your
password confidential and for everything done under your account.
Tell us promptly if you believe your account has been used without
your permission.

We may suspend or close an account that we reasonably believe is
being used fraudulently or in breach of these terms.

10. ACCEPTABLE USE

You agree not to:

  - use the site for any unlawful purpose
  - resell our products without our written permission
  - misrepresent our products, or make health claims about them
    that we do not make
  - attempt to gain unauthorised access to the site or its systems
  - use automated means to scrape, copy or overload the site
  - upload anything harmful, abusive, or infringing

11. INTELLECTUAL PROPERTY

The Atoshia name, logo, label designs, product photography, and
all text and content on this site belong to us or our licensors.
You may not copy, reproduce or use them without our written
permission.

You may share links to our pages.

12. USER CONTENT

If you submit a review, photo, comment or other content, you keep
ownership of it, but you grant us a non-exclusive, worldwide,
royalty-free licence to use, reproduce and display it in
connection with our business, including in marketing.

You confirm that the content is yours to give, that it is honest,
and that it does not infringe anyone's rights. We may remove any
content at our discretion.

We do not pay for reviews and we do not alter or delete reviews
because they are negative.

13. THIRD-PARTY LINKS AND SERVICES

Our site may link to or rely on third-party services, including
payment processors, subscription tools and fulfilment providers.
We are not responsible for the content, policies or practices of
third parties.

14. DISCLAIMER OF WARRANTIES

The site and our products are provided "as is" and "as available".

To the fullest extent permitted by law, we disclaim all warranties,
express or implied, including merchantability, fitness for a
particular purpose, and non-infringement.

We do not warrant that the site will be uninterrupted, secure or
error-free, or that our products will achieve any particular result
for you.

Some jurisdictions do not allow the exclusion of certain
warranties, so some of the above may not apply to you.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, ISDU LLC and its officers,
members, employees and agents will not be liable for any indirect,
incidental, special, consequential or punitive damages, or for lost
profits, arising from your use of the site or our products.

Our total liability arising out of or relating to these terms or
any product will not exceed the amount you paid us for the product
giving rise to the claim.

Nothing in these terms excludes liability that cannot lawfully be
excluded, including liability for death or personal injury caused
by our negligence, or for fraud.

16. INDEMNITY

You agree to indemnify and hold harmless ISDU LLC from any claim,
loss or expense (including reasonable legal fees) arising from your
breach of these terms, your misuse of the site, or your violation
of any law or third-party right.

17. GOVERNING LAW AND DISPUTES

These terms are governed by the laws of the State of Wyoming,
United States, without regard to its conflict of law rules.

Any dispute will be brought in the state or federal courts located
in Wyoming, and you consent to the jurisdiction of those courts.

Before filing anything, please email support@atoshia.com. Most
problems are faster to fix than to litigate, and we would rather
fix them.

18. CHANGES TO THESE TERMS

We may update these terms from time to time. The version in force
is the one published on this page, and the "last updated" date at
the top tells you when it changed.

Material changes to subscription terms will be notified to active
subscribers by email in advance.

Continuing to use the site or maintain a subscription after changes
take effect means you accept the updated terms.

19. SEVERABILITY AND ENTIRE AGREEMENT

If any part of these terms is found unenforceable, the rest remains
in force.

These terms, together with our Return and Refund Policy, Shipping
Policy, Subscription Policy and Privacy Policy, are the entire
agreement between you and us regarding your use of the site and
your purchases.

Our failure to enforce any part of these terms is not a waiver of
our right to do so later.
